Applies to: The ServVia Dox mobile application (the "App") and its supporting backend service (together, the "Service")
PLEASE READ THESE TERMS CAREFULLY. SECTION 8 (MEDICAL DISCLAIMER) AND SECTION 13 (DISCLAIMERS AND LIMITATION OF LIABILITY) LIMIT OUR LIABILITY AND DESCRIBE IMPORTANT SAFETY LIMITATIONS OF THE SERVICE.
1. Who we are and acceptance
ServVia Dox is provided by ServVia Technologies Private Limited, a company incorporated in India and recognised as a startup by DPIIT ("ServVia", "we", "us", or "our"). These Terms of Service ("Terms") form a binding agreement between you and ServVia governing your use of the Service.
By creating an account, or by downloading, accessing or using the Service, you confirm that you have read, understood and agree to these Terms and to our Privacy Policy (incorporated by reference). If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old and able to form a legally binding contract to use the Service. By using the Service you represent that you meet these requirements. The Service is not directed to, and must not be used as an account holder by, anyone under 18. If you add another person's lab report (including a minor child's) as a profile, Section 6.3 applies.
3. What the Service is (and is not)
ServVia Dox is an educational and wellness tool that lets you scan or upload laboratory reports, extract and organise the values, view trends and goals, keep a personal life-events journal, and receive AI-generated, plain-language educational summaries. Where a report is a radiology or pathology report, the Service only translates and explains, in plain language, what the report already states; it does not interpret images or add any finding of its own. You may optionally maintain a Health Profile and turn on Personalisation so summaries reflect context you enter yourself; this remains educational only (see the Privacy Policy for how that context is handled). Your scan history and related data are stored only on your device; our server stores no health data.
THE SERVICE IS NOT A MEDICAL DEVICE. IT DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, TREATMENT, OR CLINICAL DECISION-MAKING, AND DOES NOT CREATE A DOCTOR-PATIENT RELATIONSHIP. It is not a substitute for professional medical advice. See Section 8.
We may add, change, suspend or remove features at any time.
4. Accounts and authentication
Sign-in is provided by Google Firebase Authentication (email/password or Google Sign-In). You agree to provide accurate information, to keep your credentials and device secure, and to be responsible for all activity under your account. One account is for use by one individual. If you register with an email and password, we may require you to verify your email address before you can use the Service. Notify us promptly at contact@servvia.in of any unauthorised use. We may suspend or terminate accounts as described in Section 15.
5. Free allowance, subscriptions and billing
The Service includes a limited number of free scans. After the free allowance is used, continued scanning requires an active paid subscription. The features, allowances and prices applicable to the free and paid tiers are those displayed in the App or the Google Play listing at the time of purchase, and may change prospectively.
Paid subscriptions are sold and billed through Google Play and managed via RevenueCat. They are subject to Google Play's terms and payment, billing, renewal and refund policies. Unless stated otherwise, subscriptions renew automatically until cancelled; you can manage or cancel a subscription in your Google Play account settings. Your subscription entitlement is tied to your account so it remains available across your devices and after reinstalling the App; use "Restore Purchases" if it is not detected automatically. Except where required by applicable law or Google Play's policies, fees are non-refundable. Any statutory right of withdrawal or refund you have under your local consumer-protection law is not affected by this Section.
6. Your content and responsibilities
6.1 Your content
"Your Content" means the images, PDFs, report text, journal entries, profiles, goals and other data you provide to the Service. You retain ownership of Your Content. It is stored on your device, not by us.
6.2 Limited processing licence
You grant ServVia a limited, non-exclusive, worldwide, royalty-free licence to process Your Content solely to operate and provide the Service to you — specifically: on-device text extraction; for PDFs, transient server-side text extraction; masking of direct identifiers; and AI summarisation through the providers described in the Privacy Policy. We do not store Your Content on our servers; content sent to an AI provider is thereafter handled under that provider's terms.
6.3 Authority for other people's data
If you upload or add a report relating to anyone other than yourself (including a family member or minor child via the Family Vault), you represent and warrant that you are that person's parent or legal guardian or otherwise have the lawful authority and all consents required to provide and process their health information through the Service. You are solely responsible for that information.
6.4 Acceptable use
You agree NOT to:
- use the Service for medical diagnosis, treatment, or any clinical or emergency decision-making;
- upload content you have no right to provide, or that is unlawful;
- attempt to re-identify masked data, or access another user's data or our systems without authorisation;
- reverse engineer, decompile, scrape, or extract source code or data from the Service, except where this restriction is prohibited by applicable law;
- interfere with, overload or disrupt the Service, or circumvent usage limits, authentication, billing, or security controls;
- use the Service to build a competing product, or to train or improve any machine-learning model;
- use the Service in violation of any applicable law or these Terms.
7. AI-generated content
Educational summaries are generated by automated AI systems and may be incomplete, inaccurate, biased, or out of date. AI output is provided for general educational purposes only, "as is", without any warranty of accuracy or fitness for any purpose. You must independently verify any information and must not rely on AI output for health, medical, financial or other decisions. For certain sensitive report categories (for example, pathology, oncology, imaging, HIV/STI and prenatal reports), automated AI analysis is intentionally disabled; absence of analysis is not an indication of any result.
8. Medical disclaimer
THE SERVICE IS FOR GENERAL EDUCATIONAL AND WELLNESS INFORMATION ONLY. IT IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. NOTHING IN THE SERVICE SHOULD BE INTERPRETED AS A RECOMMENDATION, DIAGNOSIS, OR ASSESSMENT OF ANY HEALTH CONDITION.
ALWAYS SEEK THE ADVICE OF A QUALIFIED HEALTHCARE PROFESSIONAL WITH ANY QUESTIONS ABOUT A MEDICAL CONDITION OR LAB RESULT. NEVER DISREGARD OR DELAY SEEKING PROFESSIONAL MEDICAL ADVICE BECAUSE OF SOMETHING YOU READ OR SAW IN THE SERVICE. IF YOU THINK YOU MAY HAVE A MEDICAL EMERGENCY, CONTACT YOUR DOCTOR OR LOCAL EMERGENCY SERVICES IMMEDIATELY. YOUR USE OF THE SERVICE AND ANY RELIANCE ON IT IS SOLELY AT YOUR OWN RISK.
9. Privacy
Our handling of personal information is described in the Privacy Policy, available at https://dox.servvia.in/privacy and incorporated into these Terms. In summary: images are processed on-device and never uploaded; PDFs are used only to extract text transiently and are not stored; report text is masked before AI processing and is not retained on our servers; and your history is stored only on your device, unless you turn on the optional Cloud Backup, which keeps an encrypted copy in your own cloud account (never on our servers).
10. Third-party services
The Service relies on third parties, including Google Firebase Authentication, the Hugging Face hosting platform, third-party AI providers (such as Groq, Microsoft Azure OpenAI, Google Gemini and OpenAI), Google Play, and RevenueCat. Your use of those services may be subject to their own terms and policies. We are not responsible for third-party services and do not control their availability or processing.
11. Intellectual property
The Service, including its software, design, text, graphics, the "ServVia" and "ServVia Dox" names and logos, and all related intellectual property (excluding Your Content), is owned by ServVia or its licensors and is protected by applicable laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the App for your own personal, non-commercial use in accordance with these Terms. No other rights are granted.
12. Availability; changes; data responsibility
The Service is provided on an "as available" basis and may be unavailable, interrupted or limited at any time, including for maintenance, third-party outages, or factors beyond our control. Features may be experimental and may change or be discontinued. We do not store or back up your data on our servers. Uninstalling the App or clearing its storage will permanently erase your on-device data. You may enable the App's optional Cloud Backup, which stores an encrypted copy of your data in your own cloud account (for example, your Google Drive); that backup lives in your account under your storage provider's terms, and you remain responsible for keeping access to that account and for keeping your own copies of important information. We do not control, and are not responsible for, your cloud provider or the availability of any backup held there.
13. Disclaimers and limitation of liability
13.1 Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL CONTENT AND AI OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT THE SERVICE OR ANY AI OUTPUT IS ACCURATE, COMPLETE, RELIABLE, OR SUITABLE FOR ANY HEALTH-RELATED PURPOSE.
13.2 Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ServVia AND ITS CONTRIBUTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR HEALTH OUTCOMES, ARISING OUT OF OR RELATING TO THE SERVICE OR YOUR RELIANCE ON ANY OUTPUT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US (OR THROUGH GOOGLE PLAY FOR THE SERVICE) IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE THOUSAND INDIAN RUPEES (INR 1,000) OR ITS EQUIVALENT.
13.3 Mandatory rights
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain liabilities (for example, for death or personal injury caused by negligence, fraud, or certain consumer rights). Nothing in these Terms limits any liability or right that cannot be limited or excluded under the law that applies to you, and the disclaimers and limits above apply only to the fullest extent permitted by that law.
14. Indemnification
To the maximum extent permitted by law, you agree to indemnify and hold harmless ServVia and its contributors from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or related to (a) your misuse of the Service, (b) your violation of these Terms or any law, or (c) your provision of another person's information without the authority or consent required by Section 6.3.
15. Suspension and termination
You may stop using the Service at any time and may delete your account and on-device data using the in-app "Delete Account" function. We may suspend or terminate your access, with or without notice, if we reasonably believe you have violated these Terms, created risk or legal exposure, or if we discontinue the Service. Cancelling your subscription is done through Google Play. On termination, the licences you granted end (subject to Section 6.2), and provisions that by their nature should survive (including Sections 6.3, 7, 8, 9, 11, 13, 14, 16 and 17) will survive.
16. Governing law and disputes
These Terms are governed by the laws of India, without regard to conflict-of-laws rules, and the competent courts in India will have jurisdiction, subject to the paragraph below. Before filing any formal claim, you agree to first contact us at contact@servvia.in and attempt in good faith to resolve the dispute informally for at least 30 days.
If you are a consumer, nothing in this Section deprives you of the protection of mandatory consumer-protection provisions, or of the right to bring proceedings in the courts, of the country where you reside.
17. Changes to these Terms
We may modify these Terms from time to time. If we make material changes, we will update the "Last Updated" date and provide reasonable notice (for example, in the App or at https://dox.servvia.in/). Changes are effective when posted unless stated otherwise. Your continued use of the Service after changes take effect constitutes acceptance, to the extent permitted by law. If you do not agree, stop using the Service and you may delete your account.
18. General
These Terms and the Privacy Policy are the entire agreement between you and ServVia regarding the Service and supersede prior agreements. If any provision is held unenforceable, the remaining provisions remain in effect and the unenforceable provision will be enforced to the maximum extent permitted. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of all or part of our business or assets. We are not liable for failure or delay due to events beyond our reasonable control. Headings are for convenience only.
